Supreme Court Clarifies Rules on Labor-Only Contracting in the Philippines
The Supreme Court of the Philippines clarified that the absence of tools, equipment, or machinery on the part of a contractor does not automatically constitute illegal labor-only contracting under Philippine labor laws.
According to the Court, a contractor may still be considered a legitimate independent contractor even without substantial equipment, provided that such tools or machinery are not necessary for the performance of the contracted work or service.
