ARGA LAW | Supreme Court decision on Dominant Marks and Trademark Registration in the Philippines

The Supreme Court reaffirmed that a trademark may be denied registration when its dominant visual features are confusingly similar to an existing mark, notwithstanding the addition of other words or descriptive terms.

In this case, the SC found that the stylized “W” remained the dominant element of the parties’ marks, creating a likelihood of consumer confusion despite the inclusion of “GLOBALCENTER,” “FIFTH AVENUE,” and “TOWER.”

This ruling underscores the importance of trademark registration and brand protection in the Philippines.
